The Companies Act 71 of 2008
updated with July 2024 amendments
The amendments to the Companies Act 71 of 2008 as amended, as provided for in the Companies Amendment Bills, 2023 have been signed into law as Acts of Parliament on 25 July 2024.
The commencement dates of these Acts must still be announced in the Government Gazette.
The original Companies Amendment Bill was delayed and augmented with the Companies Second Amendment Bill following the outcome and recommendations of The Judicial Commission of Enquiry into Allegations of State Capture, Corruption and Fraud in the Public Sector including Organs of State (the Zondo Commission).
These amendments mark a pivotal moment in enhancing our corporate governance framework, aiming to foster greater transparency, accountability, and efficiency within the business sector. Key changes include streamlined reporting requirements, enhanced provisions for shareholder rights, and improved mechanisms for dispute resolution. We encourage everyone with an interest in Company Law to buy the updated Act via our website to ensure compliance and leverage the new opportunities it presents.
